Although the oil and gas sector remains exceedingly profitable, this does not mean that all contractual arrangments and business relationship proceed as originally intended. For what was anticipated, even with the best of intentions, is not necessarily within each party's control, such that there might well come a time during the course of a particular contractual arrangement or business relationship that it becomes necessary to effect the termination or repudiation of the parties' current legal agreement.

Termination provisions are commonly contained within the body of the contract, such that those termination clauses on occasion provide a means to effect the end of the contractual arrangement.

Nevertheless, most contracts lack adequate means to effect the termination or repudiation of the contract in the specific circumstances. As such, terminating or repudiating an existing legal agreement that the parties either negotiate the conclusion of their business relationship or resort to the adversarial process, be it through mediation, arbitration or litigation in court.
